Terms and Conditions of Sale

Pyxis Suisse SA is a consulting and training company specialized in Agility, registered in the commercial register of the canton of Vaud, Switzerland, under the IDE CHE-436.164.492.

Its registered office is located at rue du Simplon, 37, c/o CBC-L Sarl, 1006 Lausanne.

Pyxis Suisse designs and delivers public and private face-to-face and virtual classroom training.

PURPOSE OF THESE GCVS

The present general terms and conditions of sale (hereafter “GTC”) define the contractual relationship and the conditions of service between the buyer (hereafter “client” or “participant”) and the provider, Pyxis Suisse SA (hereafter “Pyxis” or “Pyxis Suisse”). They apply to the public face-to-face and virtual classroom training services offered by Pyxis Suisse (hereinafter “courses” or “training”).

Any registration for a training course implies the full and unreserved acceptance by the Customer of the present general terms and conditions of sale, which prevail over any other document given to the Customer.

The parties to the course contract are the natural or legal person who signs the registration, i.e. the Client, on the one hand, and the company Pyxis Suisse on the other hand.

COURSE OFFERING

Pyxis Suisse can also provide private, in-company training.

REGISTRATION

By registering, the Customer acknowledges having read the prerequisite level and the general sales conditions.

a. The registration to the courses must be done on the website pyxis-suisse.ch

b. The Customer must enter his information (name, first name, email and billing information) online and validate his registration by clicking on Confirm.

c. The Customer chooses his means of payment (by credit card or by transfer upon receipt of the invoice).

d. He/she will then automatically receive an e-mail indicating that his/her registration has been accepted and the invoice for the chosen course or payment by credit card.

e. A few days before the course, the client receives an email from Pyxis Suisse with all the information related to the course (preparation, location, address, etc.)

Registrations are considered valid as soon as the customer has clicked on Confirm and Pyxis sends a confirmation email with the invoice to be paid. The registrations become effective when Pyxis Suisse has received the payment within the indicated time (see section Financial conditions, rules and payment methods).

FINANCIAL CONDITIONS, PAYMENT AND TERMS OF PAYMENT

Suite à la validation de son inscription en ligne sur le site web pyxis-suisse.ch, le Client reçoit un email de confirmation et un e-mail avec la facture du cours.

Le paiement du ou des cours pour le(s)quel(s) le Client s’est inscrit peut s’effectuer par carte bancaire sur le site ou par virement bancaire à réception de la facture. La facture devra être acquittée au plus tard deux jours avant le cours choisi.

The information of the account to which to make the transfer is available on the invoice.

Any day of training started or completed is due and will be invoiced to the Customer on the basis of 100% of the current rate.

PRICE

The rates are indicated mainly in Swiss Francs (and sometimes in Euros).

The payment of the invoice cannot be done in several times.

Promotional offers (Early Bird rate, Loyalty rate, etc.) are not cumulative.

CANCELLATION, ABSENCE OR POSTPONEMENT

Any cancellation, absence, withdrawal of the Participant before the beginning of the course or stop during the training must be brought to the attention of Pyxis Suisse in writing via an email sent to suisse.info@pyxis-suisse.ch

1. Cancellation by the Customer

For face-to-face training :

  • No later than 21 days prior to the course date: In the event that the Client cancels his/her participation no later than 21 days prior to the course date, the Client’s registration will be cancelled without charge. If the course has already been paid for, the full amount will be refunded. If the Client wishes to postpone his participation on another course offered on the calendar, Pyxis Suisse will postpone his participation to another date scheduled on the calendar without additional cost.
  • If the cancellation is made less than 21 calendar days before the start of the course, 10% of the course fee will be charged.
  • If the cancellation is made less than 14 calendar days before the start of the course, 50% of the course fee will be charged.
  • If the cancellation is made less than 4 working days before the start of the course, 100% of the course fee will be charged.
  • If the client is absent from the course, 100% of the course fee will be charged.

For remote virtual classroom training:

  • No later than 14 days prior to the course date: In the event that the Client cancels his/her participation no later than 14 days prior to the course date, the Client’s registration will be cancelled without charge. If the course has already been paid for, the full amount will be refunded. If the Client wishes to postpone his/her participation on another course offered on the calendar, Pyxis Suisse will postpone his/her participation to another date scheduled on the calendar without additional cost.

  • If the cancellation is made less than 14 calendar days before the start of the course, 10% of the course price will be charged.
  • If the cancellation is made less than 4 working days before the start of the course, 50% of the course fee will be charged.
  • If the cancellation is made less than 24 hours before the start of the course, 100% of the course fee will be charged.
  • If the client is absent from the course, 100% of the course fee will be charged.
2. Cancellation by Pyxis Suisse

Linked to an insufficient number of registrants

Pyxis Suisse reserves the right to cancel a face-to-face course up to 7 days before the date of the course and up to 3 days before the date of a virtual classroom course if there are not enough registrants.

In this situation, Pyxis will propose a suitable alternative to the Customer (postponement of the registration for example). In the event that no alternative can be found, the registration fee will be fully refunded to the Customer.

Linked to an external event

If the cancellation of the course results from an event of force majeure or fortuitous (trainer sick or victim of an accident, external social conflicts, natural disasters, fires, floods, malfunctioning of communication tools, transport problems… and other circumstances beyond the control of Pyxis Suisse), the Participants registered to the course will have to choose among the following options

  • Postpone their participation to another course offered by Pyxis Suisse, at no additional cost.
  • Cancel their participation. In this case, the entire amount paid will be returned to them by bank transfer.

Pyxis Suisse will not reimburse all or part of the transportation or accommodation costs incurred by the Client to attend the training. It is the client’s responsibility to select “no-cost” options in order to receive a refund if the course is cancelled.

3. Postponement of the Client’s participation

If the Client cannot attend the course he/she has registered for, the Client has the possibility to postpone his/her participation to a course offered by Pyxis Suisse at a later date. This change of dates is free of charge if the Client has requested it to Pyxis at least 14 days before the course.

If the postponement occurs less than 4 days before the date of the course and if expenses have been incurred by Pyxis Suisse for this course (room rental, meal reservation, etc.), 150CHF of penalties will be charged to the Client.

RESPONSIBILITIES AND OBLIGATIONS

Pyxis Suisse is bound to an obligation of means and not of result towards its Customers.

It shall not be held liable to the latter in case of non-performance of its obligations resulting from an event of force majeure or fortuitous event (as described above).

Pyxis Suisse is not responsible in case of failure of the participant to pass the exams related to the certification trainings of the catalog.

In the case of certification training (including an attempt at the certification exam), the participant will only be able to obtain his or her access codes for the certification exam if he or she has participated in the training.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions of Sale are governed by Swiss law.

DATA PROTECTION

Pyxis Suisse SA respects the confidential nature of the personal data communicated by its Clients and Participants and complies with the legal provisions regarding data protection.

PRIVATE COURSES INTRA “COMPANY” and AGILE COACHING

Private services (private training, private workshops, coaching) are subject to a different purchasing process and are subject to specific terms and conditions.
