General terms and conditions of sale applicable to private services
Private training, private workshops, coaching
Pyxis Suisse SA is a consulting and training company specialized in Agility, registered in the commercial register of the canton of Vaud, Switzerland, under the IDE CHE-436.164.492.
Its registered office is located at rue du Simplon, 37, c/o CBC-L Sarl, 1006 Lausanne.
Pyxis Suisse designs and delivers public and private face-to-face and virtual classroom training. She also offers workshops, customized training and Agile coaching.
Objects of the present GTC
The present general terms and conditions of sale (hereinafter “GTC”) define the contractual relationship and the conditions of service between the buyer (hereinafter “customer”) and the provider, Pyxis Suisse SA (hereinafter “Pyxis” or “Pyxis Suisse”). They apply to the training services and workshops given privately, in person and in remote virtual classes by Pyxis Suisse (hereafter “services”).
Public training courses are subject to specific terms and conditions.
Any validation of a private service implies the full and unreserved acceptance by the Customer of the present general conditions of sale, which prevail over any other document given to the Customer.
The parties to the course contract are the natural or legal person who signs the registration, i.e. the Client, on the one hand, and the company Pyxis Suisse on the other hand.
Course offerings
The pyxis-suisse. ch website is the official support for public and private courses.
Customized training and workshops can also be created to meet the client’s needs. Following the discussions with the client, Pyxis Suisse will share with the client a detailed proposal including the content, the material and pricing conditions.
Validation of the purchase of the service
Following the discussions between Pyxis and the Customer, Pyxis sends a detailed proposal and a quote.
To validate the purchase, the customer will have to sign the quote (good for agreement + signature) and send it back to Pyxis Suisse.
Financial conditions, payment and terms of payment
Following the signature of the estimate and once the service is completed, the Customer will receive an invoice.
The payment of the service must be made upon receipt of the invoice and at the latest 30 days after receipt of the invoice.
The payment of the service can be done by bank transfer. The information of the account to which to make the transfer is available on the invoice.
The payment of the invoice cannot be done in several times.
Any day of training or workshop started or completed is due and will be invoiced to the Customer on the basis of 100% of the current rate.
Price
The prices are indicated in Swiss Francs or in Euros.
Cancellation or postponement
Any cancellation, or request for postponement before the beginning of the service must be brought to the attention of Pyxis Suisse as soon as possible in writing (via an email sent to info@pyxis-suisse.ch) or by phone(+41 22 575 20 75).
Cancellation request
1. Cancellation by the Customer
Once the estimate is signed, any cancellation of the service by the customer will generate penalties corresponding to 50% of the amount of the estimate (excluding tax).
2. Cancellation by Pyxis Suisse
If the cancellation of the service results from an event of force majeure or fortuitous (trainer sick or victim of an accident, external social conflicts, natural disasters, fires, floods, malfunctioning of the communication tools, transport problems… and other circumstances being able to escape the control of Pyxis Suisse), the customer will be able to choose among the following options:
- Postpone the date of the service proposed by Pyxis Suisse to a later date.
- Cancel the service.
Request for deferral
For various reasons, the client may need to reschedule the service.
In this case, the postponement must be brought to the attention of Pyxis Suisse at the latest 1 month before the date of the initially fixed service.
Both parties can then agree on a new date or dates.
In the event of a request for postponement communicated within a period of less than 1 month from the initial date of service, a penalty of 15% of the quoted price (excluding tax) will be applied.
Responsibilities and obligations
Pyxis Suisse is bound to an obligation of means and not of result towards its customers.
It shall not be held liable to the latter in case of non-performance of its obligations resulting from an event of force majeure or fortuitous event (as described above).
Pyxis Suisse is not responsible in case of failure of the participant to pass the exams related to the certification trainings of the catalog.
Applicable law and jurisdiction
These Terms and Conditions of Sale are governed by Swiss law.
Data protection
Pyxis Suisse SA respects the confidential nature of the personal data communicated by its Clients and Participants and complies with the legal provisions regarding data protection.
